1. Agreement and scope
These Terms govern access to and use of Gift Engine by business users. By installing, accessing, or using Gift Engine, you agree to these Terms on behalf of yourself and, where applicable, the business you represent. You confirm that you have authority to bind that business.
2. The service
Gift Engine helps Shopify merchants configure automatic gift-with-purchase campaigns using product, collection, or cart-subtotal conditions. The application is designed to select one eligible Gift Engine gift per qualifying cart according to its campaign rules.
Gift Engine depends on Shopify APIs, Shopify Functions, the merchant’s theme configuration, product availability, discount settings, and other Shopify services. No particular increase in conversion, revenue, margin, inventory turnover, or campaign outcome is guaranteed.
3. Merchant responsibilities
- Keep campaign conditions, gifts, inventory, product information, customer-facing disclosures, tax treatment, and shipping terms accurate and lawful.
- Test campaigns, theme behavior, discount combinations, and checkout results before making an offer available to customers.
- Use Gift Engine only with products, stores, and data you are authorised to use.
- Remain responsible for consumer-law, marketing, privacy, tax, and other obligations that apply to your store and promotions.
4. Pricing, trial, renewal, and cancellation
Gift Engine Pro launch pricing is USD $19 per month or USD $190 per year. The intended launch plan includes a 14-day free trial.
When public billing is available, subscriptions, trial details, taxes where applicable, plan changes, cancellation, and charges will be presented and managed through Shopify’s billing experience before any paid charge is approved. The final amount and terms shown by Shopify at approval control for that transaction.
Paid subscriptions renew automatically unless cancelled through Shopify before the next renewal date. A merchant must be able to manage plan changes and cancellation through Shopify without contacting support. Gift Engine does not collect payment-card details directly.
5. Refunds
Refunds are not automatic. Merchants may contact support for a case-by-case review. Nothing in these Terms limits rights that cannot be waived under applicable law.
6. Suspension and termination
We may suspend or terminate access where reasonably necessary to protect the service, comply with law, address security risks, prevent misuse, or respond to a material breach of these Terms. You may stop using Gift Engine and uninstall the app at any time, subject to Shopify billing terms for any active subscription.
7. Intellectual property
We retain all rights in Gift Engine and related materials. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the service for your internal business purposes during an active subscription or authorised trial. You retain rights in your store data and content.
8. Disclaimer and liability
To the maximum extent permitted by law, Gift Engine is provided on an “as available” basis. We do not warrant uninterrupted operation or compatibility with every third-party app, theme customisation, or promotion setup. To the maximum extent permitted by law, our total liability arising from the service is limited to the amount you paid for Gift Engine during the 12 months before the event giving rise to the claim. This does not exclude liability that cannot be excluded or limited by law.
9. Data protection
The Privacy Policy describes our controller activities. Where we process personal data from your Shopify store on your behalf, the Data Processing Addendum applies.
10. Governing law and contact
These Terms are governed by the laws of Spain, excluding conflict-of-law rules, except where mandatory law provides otherwise. The courts of Santa Cruz de Tenerife, Spain have jurisdiction unless mandatory law requires another forum. Questions about these Terms may be sent to mindflashapp@gmail.com.
